Introduction to Divorce

A divorce legally ends your marriage, allowing you to remarry or enter into a civil partnership if you wish. Since 6 April 2022, the law in England and Wales has introduced No Fault Divorce, making the process simpler and less confrontational.


Grounds for Divorce

The sole ground for divorce is that the marriage has irretrievably broken down. Neither spouse needs to blame the other or provide evidence of behaviour, adultery, or separation periods.

This means that the divorce process can be quick, less stressful, and more amicable.


The Divorce Process

To start a divorce, an application is made to the Family Court. The current court fee is £612.

The application can be made jointly by both spouses or by one spouse alone.

Once the court accepts the application, a Divorce Notice is sent to the other spouse, who will acknowledge it. After a minimum of 20 weeks from the start of proceedings, the applicant can apply for the Conditional Order (formerly decree nisi). Six weeks later, the Final Order (formerly decree absolute) can be granted, legally ending the marriage.

If either party contests the divorce, the process may take longer, but such cases remain rare under the no-fault system.
